We recently left Corralejo from a rented property in OYO BAHIA RESORT (ex The View Hotel, Mirador de Lobos). We signed an agreement with management to the effect that they would return our security deposit of 900 euros when we left. This did not happen. Despite repeated communication, all of which have been ignored, nothing has happened. We are no longer in Spain. We have asked for help from the people who were involved in the rental of the property - Ocean House Property Services and Idealista.com - but no replies of any help.

We have found out that the complex mentioned above is owned and run by a well known corrupt person called GUSTAVO JOSE BETHENCOURT GALVAN. who people seem to be scared of. There is even a Facebook page about his dodgy dealings.

Sole administrator RODOLFO BALDASCINO  and general manager VICTOR (?) of the complex have done nothing to help and have also ignored our emails. It is generally known in the area that these people (quote) '...are bad' and '...are no good'.  Why didn't they tell us?

Can anybody help?

Thanks in advance

NORMALLY THE DEPOSIT IS RETURNED AFTER ANY OUTSTANDING BILLS ARE PAID AND ANY DAMAGE TO THE PROPERTY HAS BEEN REPAIRED.

ALSO IN THE CONTRACT DOES IT SAY THAT IF YOU WANT TO LEAVE BEFORE THE END OF THE CONTRACT THE AMOUNT OF NOTICE YOU MUST GIVE?

SOME SAY 1 MONTH OTHERS 2.

I HAVE EVEN SEEN CONTRACTS THAT SAY IF YOU LEAVE BEFORE THE END OF A YEAR CONTRACT YOU MUST PAY 1 WEEK FOR EVERY MONTH THAT YOU ARE SHORT OF THE END OF THE CONTRACT.

Everything contractural was sorted out and there was no damage or outstanding bills. An agreement was signed between us to the effect that we would get the security deposit back... 'within the maximum period established in article 36.4 of the L.A.U.'

Well, this article actually gives a maximum time of one month before interest can be charged not the amount of time they have to repay it. It should be payed on the day you leave.

Anyway, that time passed on 22nd August.
